The Biden administration is preparing to sign up the United States to a “legally binding” accord with the World Health Organization (WHO) that would give this Geneva-based UN subsidiary the authority to dictate America’s policies during a pandemic.

Despite widespread criticism of the WHO’s response to the COVID pandemic, U.S. Health and Human Services (HHS) Secretary Xavier Becerra joined with WHO Director-General Tedros Adhanom Ghebreyesus in September 2022 to announce “the U.S.-WHO Strategic Dialogue.” Together, they developed a “platform to maximize the longstanding U.S. government-WHO partnership, and to protect and promote the health of all people around the globe, including the American people.”

These discussions and others spawned the “zero draft” of a pandemic treaty, published on Feb. 1, which now seeks ratification by all 194 WHO member states. A meeting of the WHO’s Intergovernmental Negotiating Body (INB) is scheduled for Feb. 27 to work out the final terms, which all members will then sign.

Written under the banner of “the world together equitably,” the zero draft grants the WHO the power to declare and manage a global pandemic emergency. Once a health emergency is declared, all signatories, including the United States, would submit to the authority of the WHO regarding treatments, government regulations such as lockdowns and vaccine mandates, global supply chains, and monitoring and surveillance of populations.

Circumventing America’s Constitution

A key question surrounding the accord is whether the Biden administration can bind America to treaties and agreements without the consent of the U.S. Senate, which is required under the Constitution. The zero draft concedes that, per international law, treaties between countries must be ratified by national legislatures, thus respecting the right of their citizens to consent. However, the draft also includes a clause that the accord will go into effect on a “provisional” basis, as soon as it is signed by delegates to the WHO, and therefore it will be legally binding on members without being ratified by legislatures.

“Whoever drafted this clause knew as much about U.S. constitutional law and international law as I did, and deliberately drafted it to circumvent the power of the Senate to give its advice and consent to treaties, to provisionally bring it into force immediately upon signature,” Boyle said. In addition, “the Biden administration will take the position that this is an international executive agreement that the president can conclude of his own accord without approval by Congress, and is binding on the United States of America, including all state and local democratically elected officials, governors, attorney generals and health officials.”

In July 2020, then-President Donald Trump withdrew the United States from membership in the WHO. Citing the WHO’s dismal performance in responding to the COVID pandemic and its ties to the Chinese Communist Party (CCP), Trump said that U.S. funding of approximately half a billion dollars per year would also cease.

In response, then-presidential-candidate Joe Biden vowed: “On my first day as President, I will rejoin the WHO and restore our leadership on the world stage.” Biden kept his promise and took it one step further, negotiating the pandemic accord.

Today, GOP lawmakers are attempting to revive the effort to take the United States out of the WHO. On Jan. 12, House Republicans introduced the “No Taxpayer Funding for the World Health Organization Act,” which was sponsored by 16 representatives.

 “Funneling millions of taxpayer dollars to the corrupt World Health Organization that serves the Chinese Communist Party is a slap in the face to hardworking American families struggling under record high inflation, and to all those whose lives and livelihoods were ruined and destroyed by the COVID pandemic. The WHO … praised China for their ‘leadership’ at the beginning of COVID-19 and has done nothing to hold the CCP accountable for the spread of COVID-19.”

It’s Never Ending!

XBB or Gryphon is a new class of Omicron variants (ie: COVID-19 subvariant) that’s coming from China. It includes BQ.1.1, BQ.1, BQ.1.3, BA.2.3.20, and XBB. This new variant (XBB) is thought to have the best ability to evade antibody protections of these newly emerged COVID variants, according to a pre-print study from researchers in China.

That study said that the new strains of Omicron, and XBB in particular, “are the most antibody-evasive strain tested, far exceeding BA.5 and approaching SARS-CoV-1 level.” Meaning, the vaccine and having previously had COVID-19 are not thought to offer the same level of protection against XBB as they have with previous strains of COVID-19.

Antibody drugs like Evusheld and bebtelovimab may also not be very effective against XBB, the study says.

“These variants are evolving to evade protection. The bivalent booster is “likely going to be protective against severe disease” with XBB but will be “imperfect against preventing infection.

Don’t panic, though they say. “When it comes to evasion of vaccine protection, it’s important to recognize that vaccine protection is not all or none.” “Even with immune-evasive variants, vaccine protection against what matters most—severe disease—remains intact.”

Wolf also uses this time as an opportunity for those already certified a winter an opportunity to dive in a controlled environment, meaning clean, clear, and relatively warm water.

Members of the local Michigan Underwater Divers Club (or MUD Club), encourage divers to use this opportunity to check out their diving gear and refresh their skills.

Individually most divers will practice their fin kicks, like the Flutter kick and frog kicks which is used to minimize stilling up the bottom, then there is working on their trim and buoyancy as they swim thru hula hoops suspended at different levels.  Many will practice doffing their equipment in the deep end, then surfacing and diving down back down to donning their equipment while sitting on the bottom.  Flooding and clearing their mask and even swimming around with no mask.

Getting in the Air

Well, I had gone flying earlier in the month and there was no snow here in SW Michigan – highly  unusual for this time of year. But right now it’s sunny and a “freezing your butt off” day with snow and freezing temperatures!  So with the snow clouds gone, the sun out,  and a density altitude of minus 3600 ft, I had to get into the air.

One Day Gone

Gone the frenzy of the day, the loosening of the hand clutching at my side. Is it real, or did it happen, was there happiness at my side? Will I remember well tomorrow of today and yesteryear gone or will time steal away the memory or lock it deep inside. Even now but with one day past, memory fades and thoughts don’t last, like burning embers glowing softly, how much longer will memories last?
